This session will cover Legislative, Judicial, and IRS Guidance of the past year as it affects individual taxpayers. The session will include new tax legislation pertaining to individuals under the CARES Act and recently issued regulations under the Tax Cuts and Jobs Act. The session is also designed to assist CPAs in individual tax planning for their clients. The session will provide coverage of the latest IRS rulings, regulations  and procedures impacting individuals as well as an up-to-date assessment of important tax court decisions.

This session will cover Legislative, Judicial and IRS guidance of the past year as it impacts Sole Proprietorships, Corporations, S Corporations, Partnerships and LLCs. The session is designed to assist CPAs in business tax planning matters. This presentation will provide an overview of the federal income tax treatment of debt discharge inside and outside of bankruptcy, foreclosures on tax partnerships, and basic corporate reorganizations inside bankruptcy. We will then discuss bankruptcy basics, including common scenarios like restructuring versus liquidation, before turning to the financial aspects of bankruptcy, such as  post-petition financing, budgeting, and reporting.

11:00 – 11:50 AM         THE CASE OF CARLOS URESTI/FOUR WINDS LOGISTICS: Socionomic Toolkit for Detecting Fraud
Dennis Elam, PhD, CPA, Associate Professor at Texas A & M University San Antonio
This presentation covers the Four Winds Logistics Fraud which resulted in jail terms for former State Senator Carlos Uresti, Four Winds CEO Stanley Bates, and Fund Raiser Gary Cain. Four Winds was supposedly organized to market frack sand to shale drillers in the Eagle Ford production area south of San Antonio. The scheme could only have been launched when positive social mood towards shale production peaked after three years of triple digit oil prices. The story is a morality play in which all parties lost their moral and fiduciary compass. Senator Uresti violated his fiduciary duty to his client causing her to place $800,000 in what would be termed a Ponzi Scheme. The case played out as front page news for weeks in a San Antonio Federal Court. Professor Elam actively followed the proceedings, making this available as an “Up Close and Personal Story of an Ethical Failure.”

 

 

Prerequisites: The method of presentation is online instruction and the program level is overview/update.  There are no prerequisites for these presentations nor is there any advanced preparation required.
